Reports and Examinations for Third Parties (Insurance/Solicitors/Schools/ Employers etc)
From 1 May 2007 the VAT guidance was amended following the D’Ambrumenil ECJ ruling. In principle services that provide a primary purpose of protection, maintenance or restoration of health is exempt from VAT. Services that do not clearly fall into these categories MUST be deemed as Standard Rated services and therefore standard rate VAT is applied. Brief guidelines are as follows:
v Medical Reports for insurance companies regarding acceptance of applications, claim on insurance, handling of policies and claims or health screening are all exempt from VAT (E) – Insurance Exemption rules.
v Work generally done under a statutory fee e.g. Cremation Fees, Access to Medical Records is exempt from VAT (E) or Out Side the Scope of VAT.
v The signing of :
Local Authority Forms e.g. Blue/Orange Badge Forms / Council Forms
Benefits Agency e.g. DS1500
Dept of Work & Pensions e.g. Attendance Allowance Exams / Reports
Are ALL Standard Rated (SR)
v If the supply is of an administrative nature or a confirmation of a condition then the supply should be Standard Rated (SR)
v If work carried out for a Third Party is predominantly legal in nature rather than of a medical nature, the service is Standard Rated (SR)
v Advice to the Travel Industry (Insurance Company) regarding a claim is Standard Rated (SR)
